PERM applied EB3 - Apr 2011 PERM status - Audited and denied APPEAL: Appeal has been filed.(status: Brief Filed) Extension: Applied for extension to recoup out of country time(4 months) but recd a 3 year extension and not out of country time. Can I use this extension to switch companies would that be a good idea? Also will there be an issue with the term that I will be getting for the new company on the H1 xfer? My employer is planning to file another EB2 PERM in Dec but I am not too confident . Please guide as I have recd a good full time oppurtunity and I would like expert opinion before taking a call. pontevecchio Posted November 2, 2012 Report Share Posted November 2, 2012 I suspect the Lawyer who filed the H1 extension should be the one to talk to. You will not get anywhere near expert answers to specific points of law in the forum. Give your Lawyer a call. I think you are able to use the three year extension with another company. I have recd a fulltime with another employer but i may not be able ask the lawyer of the old firm abt the visa xfer and its complications. If you can guide me to know on a denied perm which is under appeal for which i have recd a 3 year extension. Can i use this to switch employer and also will i be able to get the same term when the VISA xfer happens that will be of great help.
