BATHIJA Posted October 31, 2012 Report Posted October 31, 2012 IS I 140 helpful in Visa stamping - is I 140 approval helpful when we go for Visa stamping ? or it turns out to be a negative point for Stamping authority to reject the visa. also is I 140 and I485 helpful in visa extentions for us to get visa ? or it doesnt matter. i want to file for GC and i have 3 years of Visa left and i am thinking if filing for GC now would be helpful or should be filed at the 5th year.

shandan Posted November 6, 2012 Report Posted November 6, 2012 I am going to assume when you are saying VISA you mean H1B, as there are multiple kinds of VISA, and I-140 can have different effect on those. As for H1B it is a dual intent VISA, so by having an approved I-140 there should be no adverse effect on your H1B stamping. As far as extension of H1B beyond the initial 6 years, yes an approved I-140 has an effect it lets you use the approved I-140 to file for another 3 year extension beyond the intial 6 years. As far as filling for GC goes if you have any idea about the back log for India, then you would not wait even a single moment to file for GC, right now and get in line.
