Unused h1b approval. Is transfer possible?

Hi

I have a h1b visa approval for this year. I was in US on OPT status and in July 2012 I had to return back to india for some reasons so i quit my job. So i didnt get to work on h1b status.

Am i cap exempt if i find a new employer. ?

I have been reading on internet that If you have unused approved h1b, you cannot be cap exempt since it was never used. and so i can't apply for transfer.

Is it true?
