Giving up H1B and Greencard

I have decided to quit my job and go back to my country.

This will be a voluntary leave, not a layoff or forced termination.

I am wondering what would be the best way to carry out this mission?

My main concerns are:

  • What do I do with tax returns for 2012 - I probably won't be in the U.S. by the time my W-2 is ready.
  • How do I end everything voluntarily? Do I have to file anything or report to anyone about it?
  • How many days do have I before I leave the U.S. once I quit my job?

My status in summary:

  • Currently on a second-term H1B Visa (expires 6/30/2014).
  • Currently in the process of applying for the green card.
  • My PERM application and the immigrant petition (I-140) have both been approved.
  • My priority date (2/7/11; EB-3) is currently backlogged so the application to adjust status (I-485) is currently on hold.

The employer would have to send the W2 to you abroad. You can file a US tax return online nowadays.

How do I end everything voluntarily? Do I have to file anything or report to anyone about it?

The employer is required by law to tell USCIS that you no longer work there so that USCIS can revoke the H1.

How many days do have I before I leave the U.S. once I quit my job?

Zero days. If you need some more time, you should file a COS to another status, e.g., B2.
