h1bvisa_canada Posted October 15, 2012 Report Share Posted October 15, 2012 Hello, Please provide your expert opinion on this case. I converted from F1 to H1B and got 1 year approval initially. Applied for H1B extension and got denied after answering an RFE. I am currently on EVC model. 1) How long can i stay in US? Am i supposed to leave the country immediately? 2) Can i continue to work from India, if i leave the country? 3) I am married and my husband is on H1B? Which is the best option, converting to H4 or F1? 4) Do i come under the quota if i need to re-apply for my H1B back from H4 or F1? 5) If i my vendor or client is willing to file for my H1B, can i continue to stay in US and work? cooldude76 Posted October 16, 2012 Report Share Posted October 16, 2012 immediately convert your visa to H4(to be in status in US) then any employer can sponsor your H1(cap exempt as you already had an H1) you can start working only after the H1 approval is received(better to go for premium processing) All the very BEST Link to comment
JoeF Posted October 16, 2012 Report Share Posted October 16, 2012 If your H1 is expired, you have to stop working immediately. You could of course work from abroad. US laws apply while in the US only. But with your husband in the US, is that really an option? As for F1, universities have deadlines. The fall quarter/semester has started already. So, a change to H4 would be the best, and you should do that ASAP. Link to comment
