Attorney_19 Posted June 14, 2011 Report Share Posted June 14, 2011 If one's green card was already approved before one got married, then it will be necessary to file Form I-130 Petition for Alien Relative on behalf of the new spouse. The I-130 will be in the family-based second preference A category (FB2A). It usually takes about 5 years for the priority date to become current on the FB-2A cases. Link to comment
Evoware19 Posted June 17, 2011 Author Report Share Posted June 17, 2011 If my fiance comes to the US on a H1B and we get married here, will it be faster for him to get a GC? Or should i wait till I get my citizenship in 2013? I know it would take 3 yrs for my spouse to get a GC if i marry him after i get my citizenship, but can he come to the US immediately after we get married and is he eligible to work here within that 3-yr period.
