desidesmoines Posted July 13, 2012 Report Share Posted July 13, 2012 Hi Friends, Yesterday I heard that Grassley has lifted his ban on HR3012 which is nothing but the "Fairness for High-Skilled Immigrants Act". Can someone share the information you have or explain in detail about this act. And the reason why I am in posting this topic in this section is, will this act prevents the H1B visa fraud? Because Grassley said that this will do it , and I hope it will do it. Link to comment
JoeF Posted July 13, 2012 Report Share Posted July 13, 2012 The bill is available on the US government site that lists all bills, thomas.loc.gov. It won't prevent H1 fraud. It has an amendment that gives the US government extraordinary powers to audit certain H1s. These powers are so large that the balance of powers that is essential to a working democracy is broken. In particular, the amendment prohibits judicial review of certain actions by the government. This wide-ranging power is probably unconstitutional. Link to comment

Hopefully, people in EB3 category will see some benefit. If this bill becomes law, EB3-ROW will see a lot of regression, and EB3-I/C will see only a small improvement. Link to comment

However, as JoeF noted the amended H.R. 3012 may not get passed because of constitutional and associated political issues with the DoL H-1B 'policing' amendments. Also, if the bill does get passed by the Senate, it has to go back to the House because of the amendments. Link to comment

This will mostly be used to harass honest and legitimate H1B cases like so so many others on this and numerous other forums. 221(g) was supposed to be used for only "certain" cases. And look where that has landed us. I wonder if they will ever realize that they are actually causing so much misery to people like us by their absurd actions. I don't understand their dislike for high skilled individuals who will actually bring in tax $$ to the US economy. Link to comment
