njoi4u Posted July 13, 2012 Report Share Posted July 13, 2012 My H1 got approved in 2009. But in 2010 W2, my employer did not my payroll for all the year(becoz i was on bench). So my 2010 W2 has 34000 instead of 51000. Right now i am on full time with a big employer. in 2011 i was consulting, now i am full time. I am goin to hyderabad for stamping (getting married also). I heard we need to drop our docs 3 days before our interview...so do they search my case and ask me why my 2010 W2 was less than min LCA wage declaration (which was 51000 acc to my employer, but naa 2010 wage was 34000) Please help guys. Does my case have any problem with that W2 thing. My current employer is a billion dollar company with 10000 employees Link to comment
JoeF Posted July 13, 2012 Report Share Posted July 13, 2012 On H1, you need to get paid all the time, even on bench. You were out of status if you didn't get paid. That may well result in problems during visa stamping. Why didn't you file a WH4 to get the money that was owed you? Link to comment

And be ready to answer questions on if you filed a complaint with DOL etc. Whether you submit your docs 3 days earlier or not, VO always can research case. Dont think advance submission will improve/reduce chances of stamping. It is started as a way of expediting stamping process in Hyderabad. Call your employer and ask this question to them ask to back you and back themselves. It is resposibility of you and your employer. As JoeF suggested it can create problems. You should try to solve it not only for your stamping but for any future process around immigration. Link to comment
