It got queried and I didn't get my 7th year extension so I had to go back to India in Aug 25, 2011. I worked for the same company in India for 6 months and then i came back to US on a H4 Visa ( my wife works in US). Now suddenly my old employer called me and told that my PERM has been approved. But I am not sure about my working status. My H1B expired (6th Year) in Aug 31, 2011. What are my chances to go back to work? Technically there are still 6 days left to complete my 6th year. Actually Expiry Date - Aug 31, 2011 Left country (US) - Aug 25, 2011 Back to US on H4 - Mar 17, 2012 please help me out here...... Link to comment
krishsm Posted July 12, 2012 Report Share Posted July 12, 2012 I think you can apply for one year extension stating that 'petition for one year extension based on PERM approval'. But I could be wrong as Im not an attorney. Contact some lawyer as soon as you can so you can apply for extension. Link to comment

As long as your PERM was filed more than one year ago and it is still valid you should be eligible for a one year H1B plus any recapture time.
