visa0271 Posted July 11, 2012 Report Share Posted July 11, 2012 Here is the scenario, my 6th year H1B ends in November. I am going to India in August and returning in September. My employee has filed green card and they are going to apply for H1B extension (7th year). But I might not get the approval before I go to India but most likely get it in September when I am in India Questions 1) Can I get the new extension stamped in Mumbai embassy in September or do I need to wait for old visa expiry? 2) If for some reason the visa extension is delayed or denied, can I still come back to US in september on my existing visa? lukky Posted July 11, 2012 Report Share Posted July 11, 2012 In your case its advisable to use your old visa stamp to come back to US. If you go for stamping, If for some reason you visa stamping is denied then VO may cancel your old visa stamp also but purely depends on VO discretion. Link to comment
