arora_vikas Posted July 10, 2012 Report Share Posted July 10, 2012 Hi All, I am planning to visit Mixico for H1B stamping. I still hold a H1B stamping which is valid till sept-2012. But this stamping is through my previous employer. My petition (I-797) from my current employer is valid till Mar-2013. My question is: If I visit mexico in this month or next month (July-2012 or Aug-2012) for stamping and by any chance if USCIS put a query then will they cancel my current H1B stamping and not allow to enter back in US? OR since I still have valid stamping till Sept-2012 (though from previous employer) so even if they put a query, they will not cancel it and allow me to re-enter US? When you have a stamping of your previous company you can still use that to travel abroad. There is no need to get visa stamped with your new company. I would suggest you going to India (If that's why you want to go to stamping for) with the old employer stamping and comeback. You just have to show your new petition and the old Visa stamp at the POE and that should be enough. Regarding your question about old Visa cancellation. No one knows the the answer for that. When I went to Mexico last month the VO cancelled all my old visas when I went to interview but all my old visas were already expired. So I am not exactly sure what the VO would do if your old visa is still valid. Probably someone who had already visited Mexico/Canada with a valid visa in their passports should be able to answer the question. Link to comment
