arpug8 Posted July 10, 2012 Report Share Posted July 10, 2012 Hi, I was in US and was working with a company as a full time employee on L2 - EAD. Now came back to India as husband's L1 visa got expired and didn't get chance to apply for H1-B before quote completion for this year. My company in US has asked me to continue work for couple of more months from India and asked me to check if there is any visa option for me to go back and join the company again. My question is that can my company file for my L1-visa? They have offices in India too but is this possible for US company to file for my L1-B visa? Or is there any other visa option for me to go back and join them again? Thanks. Any hep is appreciated. Link to comment
cooltoo8190 Posted July 10, 2012 Report Share Posted July 10, 2012 To apply for L1, one needs to work out of US for 1 year. so you have to work from India for 1yr and then only you can apply for your L1 visa. Link to comment

As I am employed by US company, can I work for a year in India with them and can tey file my L1 after an year? Or do I need to be transferred to India company for an year and then transfer to US again on L1? Link to comment

JoeF Posted July 12, 2012 Report Share Posted July 12, 2012 For an L1, you would need to work for the foreign branch of a company for at least one year, and then you can get an L1 for the US branch of the same company. Link to comment
