Deepti1975 Posted July 10, 2012 Report Share Posted July 10, 2012 My husband visa was stamped for a period 23rd Oct'1998 to 15 june 2001.He could not able to come USA during that period.Now, he is in USA for last 1 year on L1 blanket visa. He is interested in transferring from L1 to H1B.H1B quota has been finished for this year 2012. Does he need to wait till next year? Does he come under cap exempt or cap ? Link to comment

In theory the laws and/or regulations do not mandate that a person subject to the H1 cap loses his cap after 6 years. Link to comment
