I have L1 B Visa and my Visa/I-94 is expiring on 14 September 2012. My Spouse is pregnant and she has the L2 dependant visa. Her due date is 15 November 2012. My company is applying for my L1 B extension but I want to stay here up to the due date. So can some one suggest me what should i do for this or Can i submit any medical document for my visa extension. So that I will receive the rejection or REF after the due date.

I will apply on 14 Sep 2012, So till now I did not get any RFE, My question is that, If i will apply on 14 September 2012 and I will get rejection with in month then it can be issue for me. Please let me know one more thing, after applying the Visa extension in how many days I can get the response of rejection or RFE and what is the ratio of rejection.

Please help me.

Depends on which Service Center you are eligible to apply. If you apply at Vermont, it will take 2-3 months to get RFE, if you apply at California you will get RFE in a approx a month. Once you get an RFE you will get approx 84 days to respond to that. This is the standard and maximum time one gets for L1B RFE.

Once you reply back to RFE you will get decision based on your Service center. Again California may issue decision(apporval/denial) in a month and Vermont may take 2-3 months

So in worst case you have approx 4 months from 14-Sep and best case you may get upto 6-7 months. I think this you should be good till your wife delivery.

All the best.
