aleet
My I-140 was submitted last month. Lawyer would not file I-1485 because he said Hong Kong is now China (after 1997), therefore I am catergorized as China Mainland born instead of rest of the world. Is there any official link that says Hong Kong is or is not part of China in terms of I-485? I tried to google "Hong Kong I-485". I have not come across anything official from US gov sites. Thanks. aleet
Aside from ignorant comment, I found the official documents that prove Hong Kong is NOT part of China in terms of Chareability. Hope this will help other fellow Hong Konger. INA 202© implies China-mainland and HK are not the same Chargeability (foreign state). http://www.state.gov/documents/organization/87525.pdf Section N1.1 (b) shows Public Law 101-649 made HK as a foreign state. http://www.state.gov/documents/organization/87526.pdf Search for "HNK" shows HK is not the same foreign state as China-mainland http://www.state.gov/documents/organization/87527.pdf Link to comment
