catchgul Posted July 5, 2012 Report Share Posted July 5, 2012 Hi All I have an approved I-140 in EB-2 category and my inital 6 years of H1-B are completing in April 2013. I know that if I change my job now, the new company can file for an H1-B extension using the approved I-140 but my question is: Do they need to file a new PERM application and new I-140 before filing for an H1-B extension ? or can the new employer simply file for H1-B exntension using the old employers approved I-140? I really need an answer urgently. So I'll be very thankful if someone can Please respond. Link to comment

niyochat Posted July 7, 2012 Report Share Posted July 7, 2012 New PERM and I140 are only required to re-start your GC and not reqd for H1 extn. though you are eligible for 3 yrs extn approval is based on SOW/approved project in your new job. Hope it helps. Link to comment
