bobbalali Posted July 5, 2012 Report Share Posted July 5, 2012 Dear Sir I am currently on L2 (EAD) valid till Aug 2013. Me and my husband currently filed H1 , which will be valid from Oct 2012. We planned to visit india on July 30th 2012 on L1 and L2 status and returning on Aug 20th 2012 . My queries: 1. Will there be any issues if my H1 is approved during my stay in India? 2. My I 94 is valid till Aug 2013, will i get new one or how this works? 3. Will this trip effect my Visa approval? 4. Any pros and cons , if i go and comeback on L2 Visa? pontevecchio Posted July 5, 2012 Report Share Posted July 5, 2012 1. Yes. That means you will need a H1 visa to return up to 10 days before October,1. 2. You will always get a new appropriate I94. 3. You are not applying for a visa. An employer has applied an H1 petition for you. 4. Since you can work in L2 status, it makes no difference. You said " Me and my Husband filed H1" Does that mean both have H1 sponsors filing petitions for you? Link to comment
