I am in a very pathetic situation where my 140 was filled 10 days back not yet recieved the recipet notice. I have been told by my employer that my H1B extension of 7th year can be applied once we got Receipt notice. But i am not sure since my Labor priority date is March 2012 and my H1 expiration date is July 17th 2012. So please suggest me can we apply extension with 140 receipt notice or only eligible to apply extension only after 140 approval. Link to comment

carryongc Posted July 3, 2012 Report Share Posted July 3, 2012 You will not be able to file for an extension of your H1B since your Labor was not filed 365 days before the expiry of your H1B, Only hope is if your I140 has been filed in PP & gets approved before your H1B expires. pavuluri2121 Posted July 13, 2012 Author Report Share Posted July 13, 2012 By God's grace my 140 got approved yesterday, and employer is going to file H1B under premium process today using approval email. As said earlier my 6th year H1 is going to expiry on 07/17/12. So please suggest based on this situation with chances of getting my H1 approved. Link to comment
pavuluri2121 Posted July 27, 2012 Author Report Share Posted July 27, 2012 I am very lucky and this is all hapened by god's grace i got my H1 B also approved finally but they gave only for 1 year even i have 140 approval. Can some one suggest me why they usually give 1 year extension based on 140 approval. I heard they will give 3 years on 140 approval does there is any change in the rule.
