I am currently on cap-gap extension andmy H1B validity starts from OCT-1 AS USUALL. My question is that if my HIB AND/OR H4 visa gets rejected in CANAD will I be able to renter the US or I have to go back to my home cauntry directly from Canada??? giri26 Posted July 2, 2012 Report Share Posted July 2, 2012 you cannot re-enter US if your VISA is denied or if you get stuck with Admin processing. You can either stay back in Canada till a decision is made on your VISA (if in admin processing) or go back to India and wait. If your VISA is denied then you will have to go back to India. If you are on your cap-gap period that means you are out of visa status. If your visa gets rejected [i hope not] in Canada, You and your partner will have to go back to home country. Link to comment

rao454 Posted July 2, 2012 Report Share Posted July 2, 2012 If it's rejected you need to go back to home country directly. Options you have: Let's assume your on F1 and its valid till October 2012. If your current visa (F1) is valid after (H1) rejection (which means you have attended the interview before October 2012 ) you can entire US only if the visa(F1) is not Canceled without Prejudice. Canceled without Prejudice: At visa interview (officer) will strikeout your old visa... i'm not sure what it means but if he doesn't cancel your visa you have option to come back. My student F1 visa is valid till Jan-2013 but I WAS ON opt AND MY ead EXPIRED ON mAY-24 but since I had applied for h1b before that I am corrently on OPT CAP-GAP EXTENSION which states that if I leave the cauntry I have to get a valid stamp in order to get in. My question is, will my F1 visa be valid and allow me re-entry if my visa gets rejected in Canada. ??? Thank you Link to comment
