My employer ( small company with 30-40 employees) filed H1b under Master's quota in regular processing at NSC and yesterday I got layoff due to cost cutting. My h1b status still stays in process. Company filed for h1b on 4th May, 2012 My questions are does my h1b peition get revoked as soon as my employment is terminated? if employer does not cancel H1b petition can I transfer my h1b to a new employer ( if i am able to find a job ) who is willing to sponser my h1b. or do i have to apply again in next april 2013 when next quota begins.? JoeF Posted June 30, 2012 Report Share Posted June 30, 2012 If the H1 is not approved yet, it is gone. Find another employer to work for with OPT, and the employer can file an H1 on or after April 1, 2013, for the next fiscal year. Link to comment
