askquery Posted June 28, 2012 Report Share Posted June 28, 2012 Hi, I am in US on L1B, but I also have L2 visa stamped. I would like to know if I can apply for EAD, while working on L1B visa in US. My concerns/questions are : 1. Can I apply for EAD (I have L2 visa stamped) while working on L1B visa? 2. My I-94 is for L1B visa, can i use the same while applying for EAD? 3. Is there any conflict of interest if I apply EAD while already working under L1B status? 4. Will there any problem any my company side, does USCIS send any letter to company that ur employee is applying for EAD while he is on L1B?? 5. Will there be any problem if I travel to homecountry (outside US), after applying for EAD? Will there be any conflict when I return back to US considering I have L1B and have applied for EAD(if application in process at USCIS) ? 6. Is there any other kind of risk on my L1B visa on applying for EAD? Request your quick response on the above questions. Thanks in advance. Link to comment

Attorney_23 Posted June 28, 2012 Report Share Posted June 28, 2012 Having an L2 visa is not the same thing as being in L2 status. If a foreign national is in L1 status, they are not permitted to obtain an EAD. If a foreign national's spouse is in valid L1 status, he/she may apply to change status to L2 and apply for an EAD. However, once L2 status is granted, the foreign national would not be permitted to work until the EAD is issued. Link to comment
