BSDEV
Hi, My perm got denied after an audit and I still have 17 months in my last year of H1-B. Not sure if I should go for appeal process or find a new employer. Here is the reason for denial #1 The employer failed to provide a copy of the employer‘s text of the employer‘s advertisement along with a written confirmation from the radio or television station stating when the advertisement was aired. #2 The -employer indicated in Item I.d.l5 of ETA Form 9089 that it used its web site to advertise the job opportunity described in Section H. in its audit response, employer provided copies of its website with handwritten dates. However, the employer failed to provide dated copies of the pages from the site that advertised the job opportunity. Please advise if this can be appealed what is the chance of getting it approved? or should I need to find a different employer? Thanks, BSDEV Link to comment
ravi26usa
Let ur attorney decide if he should appeal.Appeal sometimes could take more than 17 months for an decision and this could help you get H1 extensions . if your attorney decides to appeal,U can't file another PERM thru same employer so think about alternate options.
