He terminated my H1B after a month of my last day of working, upon my request. My current consulting company filed a new H1B transfer and withdrew previous H1B application on which I had RFE. RFE was about the missing paystubs for a month when I got laid off. Currently I have one H1B application pending with this company in initial review stage. Now I got a permanent job with a 'Good company' which is ready to process my H1b under premium process. I have been requested by a law firm of this company to go to India before they submit my application for H1B consulate processing. The law firm told me that consulate processing will help me to get clean status and green card easily. What is the best thing to do in this situation? What are my chances of getting visa approved, stamped and come back to USA if I leave the country now? (they have submitted LCA application) Can I come back on the consulting company visa in the worst case scenario? Please let me know if you need any more information. I appreciate the help. wiweq Posted June 28, 2012 Report Share Posted June 28, 2012 "What is the best thing to do in this situation?" => If you are in US with no status, better to leave the US asap. Your employer is right. Leave the US, and let them file your H1b. Once it's approved, you can get stamping and you are all set. Because it's a FT position, stamping should be easier. Link to comment
