H1B Petition sent back to USCIS for review

Hi.,

Here my Case goes like this:

Interview Attended date in Hyderabad: 24 Feb 2012

As I was told my case is in Admininstrative process.

April 26th: received a mail mentioning my H1b is suspended and sent back to USCIS for Review

June 1st: received a mail from USCIS.,mentioning:

Application Type: I129 , PETITION FOR A NONIMMIGRANT WORKER

Your Case Status: Post Decision Activity

On June 1, 2012, a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

-->I have been looking at the forums.But its hard to find people who got the VISA Approval after this step.

1)Would like to know the Possibilities and Approval chances to happen

2)time duration for the USCIS to reply us in Approval case.

3)If at all,it is Approved-->a) do v need to submit passport fro stamping

b)need to schedule the interview again.

Would really Appreciate ur response and Views

Now the waiting part comes, USCIS can take any time, what I have seen so far is atleast 6 months. My petition was sent back early this year, USCIS received it in March and still no update.

USCIS will decide whether they want to re-affirm your case or they might need more documents from your employer. Once it is re-affirmed, then you have to contact consulate via VFS. Then they will tell you when to come for interview again.

It is not necessary that they will stamp once it is re-affirmed. So just keep waiting now.

SO do you have any idea what is the minimal time you have seen?

As per ur word: Attending VISA interview again vth re-affirmed petition may or maynot happen.,as it depends on the case and the decision take by USCIS after reviewing our case....

I wish who were successful in gettting stamp in this procedure post their experience in forums.As i see very limited ppl post d forums who got stamped.

It's going to be a long wait. Be prepared for a 6-9 month wait or more depending on your case. Weigh your options and see if you want to wait or find another employer.
