I need to complete the landing formalities asap to get the Canadian PR card. However, I am not sure if I can leave the country to complete my landing formalities and come back to US within a week while my PERM is still under process? If I can leave the country, will I have to notify USCIS? Please suggest. Thank you! Link to comment

sandeepgupta80 Posted June 26, 2012 Author Report Share Posted June 26, 2012 Yes, I do. I have a valid I-797 approval notice with I-94 attached to it. However my passport is not stampled because I haven't left the country since I have got the extension. I am planning to use Automatic Visa Revalidation program in which I don't have to surrender my I-94 when I am leaving US and I'll be able to enter while coming back to US from Canada based on my current valid I-94 (no stamping required). The only thing I don't know is whether I need to notify USCIS or not. Link to comment

gcjourney Posted June 27, 2012 Report Share Posted June 27, 2012 You can use Automatic Visa Revalidation only if your travel is less than 30 days to Canada or Mexico and by not surrendering your I-94. Link to comment
