Priority Date Porting and 485 filing with EB2-India unavailable

Hi,

My EB3 priority date was June 16, 2007. I filed my I140 with request for priority date porting from EB3 to EB2.

Now that cut-off dates are unavailable for India EB2. Once my I-140 is approved, can I still file my I485 as the last available cut-off date was August 15 2007?

Please advise.

No.

You can't file for i 485 until the cut-off dates are available (i.e. in Oct 2012 when FY13 quota opens).
