I left my previous employer 2 months back (had H1 until 2014) and joined new one. H1 has been denied with new employer (reason unknown at this moment).

Can any one help me understand

1) What is my status now?

2) I have been told that, tomorrow is my last day with the firm (from new one) (they are not gong to appeal the case). so, what would be my status after termination?

3) what options do i have?

4) how many days can i stay in US, after termination?

5) any way to check my earlier H1's status?

Any help would be appreciated!!

1) Company-A filed for H1 in 2007. Never visited USA on that visa.

3) Company-C filed for H1 in Aug-2011 and got approval. Joined C in Sep-2011.

4) Company-D filed for H1 in Apr-2012. Joined in Apr-2012 (after receiving receipt number) been on RFE for 1.5 months. just today checked the status online (DENIED!!)

You are out of status as soon as you are laid off.

There is no grace period.

If you wish to stay a bit, e.g., to sell your belongings, you should file a COS to some other status, e.g., B2.

So, I am on status as long as i am associated with current employer (with whom H1 has been denied). Am I correct?

If above statement is correct, If my previous employers hires me back before leaving new employer, I am in good status correct?

If your previous employer has not cancelled H1 and if you join them before your employer gets denied letter

then you may be in status. Your current employer supposed to give you the flight ticket to your

home country after they get denied letter. Please update your case.
