theAspirant7
Hello everyone, I have a small doubt regarding my H1b transfer and would appreciate any inputs. I'm currently working for Company A. My current H1b expires on Nov, 2012 and Company A has filed for my extension. In the meantime, I'm looking for opportunities outside. So, if I get selected into Company B, can they transfer my H1b without any problems (while the current extension is in progress)? I initially thought of premium processing at Company A, but they're not willing to go ahead and advising me against it because it increases the chances of getting a query. The assumption is that Company B will file for my transfer before Nov, 2012. So, if I have a petition # from the current extension, will that be enough? Or should I wait for 2,3 months before looking outside? Thanks for your time and consideration. Link to comment
pontevecchio
The current extension has nothing to do with the "transfer" If you are in status the new H1 petition approval will come with an I94 and you are fine. Link to comment
theAspirant7
pontevecchio: What if I haven't yet received the petition approval/i-94 from my current H1 extension? Can I still go ahead and have another company apply for my H1b transfer (while my current extension is still in process)? Link to comment
