Can i still use this priority date when my new employer files my PERM. ? Confusion: I have read in so many blogs that if 140 got withdrawn in less than 180 days of approval i can not use it for porting. When i have asked my lawyer .. He said, i can use it for porting.. I am little confused... Any prominent resource from USCIS website will be appreciated. Do i need to file for a new perm before my 6 yrs of h1 expires to get another h1 extension beyond 6 years? or Can i still use my withdrawn I140 to get the extension. My lawyer said yes, [i have Zero faith on this.. and i believe this is completely wrong..] But a prominent web link from USCIS will be appreciated. Link to comment

Stop reading dubious blogs which are erroneous. As regards H1 extensions you can get H1 extensions beyond the initial 6 years if the PERM is pending 365 days or I-140 is pending 365 days plus or I-140 is approved. Link to comment
