Hello Everyone

I got my visa cleared after 4 months from the date of interview. I got a 221g in June 2011 and the petition got sent back to USCIS. This is a new H1B. Below is the timeline. I honestly wasn't expecting this to get cleared after a bad experience with 221g in 2011. Had to sell my car, tv etc, dispose a lot of stuff. I feel the pain every 221g candidate goes thru. It is unfortunate but it is happening. Best thing is avoid the stamping or at least avoid consulates in India.

First visa interview on EVC model:

Interveiw date: June 17,2011, got 221g blue

Submitted docs with passport on June 20 2011

Passport sent back without stamp on July 11,2011

Response to email in Dec 1st week saying petition got sent back to USCIS because of employee employer relationship

Letter in post stating the same: March 2012

USCIS received the petition for review: May 7,2012, still under review

Second H1B with new employer on EC model:

New H1B approved on Feb 2, 2012

Attended interview on Feb 23rd,2012

Got 221g white asking for additional details like supervisor details etc.

Submitted docs on Apr 10,2012

Client verification done in the week of June 11

Asked to submit passport on June 15th, submitted the same day

Got the passport with stamp on June 20

Below is my second interview experience

VO (Visa Officer): Looks like you had previous visa stamping done in Mexico in 2008 and one visa refused in Chennai last year?

Me: Yes

VO: Do you know why it was refused?

Me: It was refused because of Employer-Employee relationship.

VO: Ok, so this new petition is from a new petitioner or the same one?

Me: New one

VO: Let's see if this one is any better

VO: Where is company located? city name? Can you spell that for me? or if you have any letter having the address, that should be enough.

Me: (gave him letter to USCIS which has the address)

VO: Do you work at a client place?

Me: Yes

VO: Let me take a look at the client letter

VO: Where is the client located?

Me: <city name>

VO: How many people work at <client place>?

Me: I don't know how many people work at e-solutions because I haven't been there yet. I will first report to <employer> office and then I will be assigned to <client name>

VO: So you don't know anything about the job and anything about the client location

Me: If you are trying to know what I do at the client place, I know that.

VO: That's not what I am looking for

VO: Who is your supervisor at <employer name>?

Me: Mentioned name

VO: Who manages your work at <client place>?

Me: <name of supervisor> will be my manager at <client place> assigning my daily activities, he is an employee of <H1B employer> at the client site.

VO: Can you spell that name for me?

(I spelled both names on paper and passed it over to him).

VO: Since you don't have much information about the client and your job, I will need lot more documents. I have ticked them on this sheet. After you submit them, I will do further investigation into it and take a decision

Me: How long do you think it might take after I submit them?

VO: After you submit them 2-3 weeks

Me: Thanks, you have a good one

221g was asked to submit supervisor details.

How many people work at <client place>?

=> There is a clear cut ans: There around <number> employees at <client location>.

Never say I don't know!

So you don't know anything about the job and anything about the client location

=> Both are described very well in your LCA.

Anyways congrats for stamping!

I don't know how many people work there, so I mentioned the same. I cannot bluff something by giving a number there and later if verified, be put under 'misrepresentation of facts' category. I should have found out before hand, but overlooked it before going to the interview

I clearly told him I know my job duties and description. I could clearly feel that he was just finding a way to give me a 221g. The only thing I did not know was how many people worked at client place. It was just a reason to push this into administrative processing.

=> End well, everything is well. Hope you will enjoy your H1b stay in USA. Once again, congratulations.
