hi friends

i got an offer from small company of about 25 people. they are prime vendor to big company ( about half a billion dollars in revenue), they started filing h1b only this year

my visa was rejected last year (EVC) due employee employer relationship

cleared few interviews since then, but no one is ready to sponsor due to previous rejection and current location

1. it is advisable to accept offer and go for h1b through them?

2. would it make things more difficult for me if h1b petition or visa is rejected?

please help in this regard

=> The only concern is that small company faces more problem/ rfe for H1b approval. USCIS wants to make sure that they would be able to pay you LCA mentioned salary through all your H1b stay. What if you lose your project, how would they be able to pay you salary. What are there other sources of revenue? As they don't have much revenue history, sometimes it’s tough to justify those things.

But anyways it’s you employer's problem, it's their H1b, they are paying for it and they know better how to get best from the money.

Better to go with big employer like a MNC.If you cannot wait , then go and accept the offer.But do not sign any agreement with them.

And make sure they will provide all the client and other work related documents while filing H1.If they would not provide you and if they speak doubtfully,then reject the offer.

In principle, it is fine. The issue is always that USCIS wants to make sure that the employer can pay the salary of the H1 person.

For consulting companies, there always is the pay on bench issue, so the company needs to have enough financial reserves to pay an H1 person who is on bench.

Of course, don't do anything fishy. If the company asks you to pay for the H1, or pay a "security deposit" or something similar, stay away.
