H1B validity

Hi,

My old employer filed me H1b for 2012 quota with a work start date as Oct 1st 2011. The H1b petition was approved and I know the Case number. I moved out f the company after that, so I never went for stamping nor the company gave me I797B petition to me.

Now I wish to work in USA.

Is there anyway I shall use the old H1b petition to look for new job as a quota exempt petition? If yes do i need the I797b petition?

Also my old employer is not willing to giving I797b, is there anyway I shall get it from USCIS.
