Help Needed

Hi,

Can you please advice what needs to be done in my situation.

I work as a permanent employee for a MNC and my H1B is expired last year in Jun 2011. I am still working for the same company remotely out of country with US payroll. My company filed perm in Oct 2011 and got audited and still waiting for audit reply not sure how log it takes. What options I do have.

1.Should I have to wait till Oct and apply for 1 year extension

2.Can I ask my company lawyer to apply for L1b visa (Since new H1 quota for this year is over) now as 1 year out of country is over (my company doesn't have office in India).

I don't think you can apply a L1 as you need a Registered company in India & you need to work atleat 18 months with them. You need to have a payroll as well.

The best solutiuon is to wait for the pem & apply 140 in PP . If you have any time left (even1 day by recaputure) then apply for a 3 year extension. If you don't have then you have to wait for the next year H1b ie untill 2013 Oct as H1b open in April & you can start by Oct.
