Here is what happened: Nov 16th - both of us got our EAD and advance parole approvals Dec 17 - We got one RFE for 2 both of us (It has names for both of us and asks specifically for the birth certificates for both of us). Jan 9 - USCIS recieved our reply with both our birth records and the only RFE we had recieved. My case status got updated to response recieved and my wife's status remained at RFE. Feb 2 - I recieved my green card and my wife case status is still RFE - I followed up (Called and took infopass appointment) - was asked to send the same documents again. Feb21 - recieved wife's notice of action - (approval) for wife - Recieved no green card. April 21 - Followed up (Called and took infopass appointment) - Recieved an email that uscis will send the biometrics appointment again - recieved no such notice. May 30 - (Called and took infopass appointment) - was told that the biometrics are in the system, and the card was never sent for production - Local office is going to send an email - nothing recieved. Now the Wife's EAD expires in Sep 2012 - Should I apply for another EAD? I don't know what else to do - PLease help. Link to comment
Belle Posted June 19, 2012 Report Share Posted June 19, 2012 Well, you can't and should not apply for anything. I think, it is the best if your wife files for a replacement green card. She may also get a stamp in her passport, which she can use for work or to exptend her DL. Link to comment
SameerH1Bworker Posted June 19, 2012 Report Share Posted June 19, 2012 You can take another infopass & as your wife's GC has been approved, so, USCIS office will stamp her passport with temporary GC validity. Few of my friends did in past. Link to comment
maverick_1978 Posted June 19, 2012 Author Report Share Posted June 19, 2012 I just recieved an email from USCIS: I am not sure what to do as I never recieved the Biometrics appointment letter. the Texas Service Center is currently waiting to receive your biometrics. If you have not been scheduled for a biometrics appointment, you will receive an appointment notice as soon as there is an available date and time at your local ASC office. Due to backlogs at some sites it may take more than 60 days for this appointment to be scheduled. Once your biometrics is received, we will produce the card and mail it to you. If you have received your notice but missed your appointment, please follow the instructions on the bottom of the letter to reschedule your appointment. maverick_1978 Posted June 21, 2012 Author Report Share Posted June 21, 2012 Thanks for the replies Belle / Sameer. I did try for the passport stamping of the green card. It was not done as the card was not sent to production. I contacted the local office which says that biometrics are on file and the USCIS immigration officr has sent a note that it is not. I have not recieved the new fingerprinting appointment. Any other new ideas given the situation I am in? and again Thanks for all te help. Link to comment

I just am the internet researcher and poster! anyway - the question is still out there - a) what to do if the local office and the service cnter do not agree on the existence of the biometrics? b) what to do if the local office refuses to stamp the passport as the card has not been sent for production. c) what to do if the service center says that the biometrics are not on file - but does not send the biometrics notice. I have filed I90 but it is unlikely to be processed before the expiry of the current EAD. so I would say I (as in my wife) is in a catch 22 here. Link to comment
pontevecchio Posted July 3, 2012 Report Share Posted July 3, 2012 It is no doubt true that almost all the heavy lifting is over. Please involve a Lawyer to deal with the matter. The money spent will give you results and that is priceless. You could try getting an INFOPASS appointment and politely explaining the situation. INFOPASS is manned by Officers and not the clerical staff who answer phone queries and a good Officer may be able to help her. If that fails let the Lawyer do his job. Link to comment
