(I-797B, client letter has validity till Sep/2012 but LCA having validity till 2014 Q2) Should I start the process of visa extension here in India, and travel only once it gets extended. But he is forcing me to join within two weeks, but I cannot join before Aug. According to employer after august it will be tough. So here my question is Can I stay in US even after my visa expires, considering I have already filed for extension? Link to comment

Diorsdune Posted June 25, 2012 Report Share Posted June 25, 2012 @simple_delhi - An extension for the H1b permit is typically filed 2-3 ahead of the expiry. However, that is not a rule. If you go through the older posts on this forum you will see a few cases people have applied for an extension only 10 days before the expiry of their permit. It is best to apply with at least one month at hand & not delay any further. If you HAVE to be in India till August & that cannot be negotiated then be it so. If your employer is willing to hire you in August.. technically there is no stopping you from applying for a extension filing in August either. However, if you can travel to US earlier then that would be the best option. I know once you are in US & have applied for an extension then you cannot travel out of US.. I don not know what happens the other way around. Hope this helps. Link to comment
