If I resign to company A and go to US on H4.If my H1 is revoked by comp A after I resign.In this case Can the Comp B can file a petition or COS from H4 to H1 and is it cap exempt? Do I need to wait for next year quota? revoked H1 is cap exempt? Link to comment

Attorney_22 Posted June 19, 2012 Report Share Posted June 19, 2012 Generally, if an individual has been previously counted against the H1B cap and has not utilized their allotted six years of H1B time, that individual should be eligible for H1B status without applying in the H1B cap for that coming fiscal year.
