ChrisHD Posted June 14, 2012 Report Share Posted June 14, 2012 hi everyone, my national interest waiver for physicians petition was approved last year. i subsequently filed for adjustment of status. it is my understanding that niw physicians cannot adjust to permanent resident status until the physician has completed 5 years of aggregate service in a medically underserved area or va facility. however, at the time my application for adjustment of status was approved i only had served approximately 2.5 years of my medical service requirement. in addition, my application for adjustment of status was approved prior to the completion of my j-1 waiver 3 year medical service requirement. i called uscis and was told to make an infopass appointment. however, my concern is that there my green card may be confiscated without uscis fixing their mistake so that i am not at a disadvantage. could this indeed happen? same thing happened to a friend of mine a few months back. his lawyer called uscis but so far they have not returned his calls. he also contacted the uscis ombudsman, a response is stil pending. any ideas on how to proceed? ChrisHD Posted October 6, 2012 Author Report Share Posted October 6, 2012 here is what happened: talked to lawyer at murthy law firm who advised me to contact the uscis ombudsman. uscis ombudsman (extremely helpful!) contacted uscis service center on my behalf. service center reverted my application for adjustment of status back to pending after i filed i407 and abondoned my green card at local field office. entire process took approx 3.5 months.
