swaroop2 Posted April 9, 2012 Report Share Posted April 9, 2012 Hello All, I'm working for company A and got I-140 approve through them in EB-3 category. Now I'm planning to move to company B to port the GC process from EB-3 to EB-2 as I got qualified to apply GC in EB-2. Now my current employer ( company A ) is saying that they will hold I-140 just for six months or may be one more month, in the mean time I have to apply GC through company B and should be in a position to file I-140 before he cancels I-140 which I already got through his company. Actually I want to retain my EB-3 priority date, use the same date for EB-2 Is it true that if any company cancels I-140 then we will loose the priority date?
