Attorney_22 Posted April 4, 2012 Report Share Posted April 4, 2012 Generally, as long as a Beneficiary’s priority date is not current they will be eligible for H1B extensions in three year increments. If the priority date is current the Beneficiary is eligible for H1B extensions in one year increments. However, even when an individual is eligible for a three year extension, USCIS will make the determination on a case-by-case basis after review of the documentation supplied with the H1B petition.
