VM211 Posted March 27, 2012 Report Share Posted March 27, 2012 If you and your spouse filed based on YOUR priority date and you selected '(b)' in Part 2 of the I-485 application of your spouse, then what you indicated is true. The spouse PD on receipt should be the application receipt date. I confirmed with my lawyer about this. So what does that mean? My spouse ! 485 application PD date would remain as receipt date and her application would not be processed according to my PD date. IF thats the case what has to be done? Link to comment

USCIS will adjudicate both of your applications based on YOUR priority date. Link to comment

Although the PD on your spouse's document is the application filing date , both you and your wife have the same PD (which appears on your document). i.e. Nothing has to be done. Both of you will be finger printed in the same time-slot and receive EADs together. Link to comment

VM211, I'm dependent on my wife's application and my priority date was printed as the receipt date. But this does not have any consequence on the processing. The ppl that got FP EAD/AP are from TSC. According Murth,******** and other sites the case moment is very slow at NSC. Link to comment
