My employer has failed job market test as part of my job market testing for Labor certification. What options do I have to file my PERM. A friend of mine has suggested me to go on H4 while I still have a few weeks left on H1-B, then start Labor and I-140 from another employer and after the I-140 has been approved, capture the few weeks left on my H1-B and in addition add the 3 years from the approved I-140. Does any know if this is practically possible? Also will there be any issues on getting H1-B after I-140 gets approved? Link to comment
JoeF Posted February 28, 2012 Report Share Posted February 28, 2012 No sane employer would spend the money to file PERM for you without having first-hand knowledge of your qualifications, etc. If you go with some shady consultant, you can expect a lot of scrutiny.
