park Posted February 26, 2012 Report Share Posted February 26, 2012 Hi I had H1 visa with Stamping from 2007 to 2010 October. But Unfortunately I did not travel during that Visa time period. I came to US with another company on L1 in Nov 2010. Can I reuse my old H1 with another new empoyer with out being counted against the H1 Quota... Your advice is appreciated Link to comment
Attorney_10 Posted February 27, 2012 Report Share Posted February 27, 2012 Generally, an individual is only counted against the numerical H1B cap if s/he is in the U.S. when the H1B petition and change of status take effect or s/he was issued a H1B visa by a U.S. consulate abroad. Otherwise, the chance of successfully arguing that the individual has been counted against the cap is diminished.
