If I get H1B extension based on the approved I-140 with the Company A , can I do H1B transfer to company B when I change job next year . Also let me know if these will lead to any complications . noauditplz Posted February 20, 2012 Report Share Posted February 20, 2012 Yes you can transfer but be prepared for any RFE's in relation to I-140's and PERM. if your old employer does not revoke your I140 while transfer is happening then you will be good to the term that USCIS provides with new employer. if you get only 1 year with your new employer(most likely if they operate in EVC or EC), then there is a possible situation that you will be catch 22 situation for extension after that because your new employer need to complete PERM and I140 with in that time to prove that your H1B extension is based on existing approved I140. consider time it takes for H1B,PERM,I140 and if any RFE's for each of them with new employer Link to comment
