hook03
I have applied for my AOS in December. After that I read in some forum that birth has to be registered with in 1 year of birth , otherwise some affidavit need to be attached from parent/relative. In my case, I have applied for birth certificate in 2010 and officer mentioned same date as registration. Will there be any RFE for this? Anyone got the approval without RFE in this case? sonu
if the date of registaration is within one year of your DOB, you are fine,if not you will need 2 affidavits of birth. In your case you will need the affidavits. you most likely will get a rfe,, get the affidavits ready in the meanwhile. Link to comment
tusharvk
I am not sure where this is mentioned. on the 485 instructions or elsewhere that the dates of birth and registration have to be no more than 1 year apart? Link to comment
dec2008
Yes, USCIS will need secondary evidences if the birth was registered after more than 1 yr of birth I am not sure where this is mentioned. on the 485 instructions or elsewhere that the dates of birth and registration have to be no more than 1 year apart? Belle
I would just wait for the RFE. If it is not in the instructions, it is possible that there is a certain level of discretion that the officer will be exercising. It's not like you are trying to get into a highly lucrative category by presenting questionable evidence. Link to comment
