My employer applied for H1B in december and I received I 797C form with approval date for 2 years. But noticed that that form does not have I 94. Chitown01 Posted February 6, 2012 Report Share Posted February 6, 2012 I-797 C is the Receipt and NOT approval notice Your Attorney should have received I-797 A and there will I-94 attached on the lower section, if you received I-797 B, then there will be NO I-94 and you will have to leave the country get stamping done and re-enter.... wiweq Posted February 7, 2012 Report Share Posted February 7, 2012 I797C is a courtesy copy of the H1b approval. Ideally, this is sent to attorney/ employer for their records purposes only. This doesn't include I-94. This happened to me too a couple of months back. Got a copy of I797C with no I-94, but after few weeks I got I-797A , it had I-94 too. Link to comment

noauditplz Posted February 7, 2012 Report Share Posted February 7, 2012 I797C is not your approval document. that is just your copy of approval notice. your employer or attorney will have the original approval document which will be quoted as I797A/I797B. if you receive I797A/B without I94 you have to leave the country immediately and have the visa stamped and acquire new I94. if you receive I797A with i94 then you are all set Link to comment
