prvn Posted January 26, 2012 Report Share Posted January 26, 2012 Hi Experts, I have an approved I-140 in EB3 from employer A and now found another employer B who is ready to apply me the GC in EB2. My present employer A is going to revoke my I-140 soon I resign him. I am not sure whether I can retain the PD with the revoked I-140 so convinced new employer B to join after PERM is approved so that I can apply 140 in premium before my present employer A revokes the current 140. My question here is, what extra difficulty I am going to have if I join after PERM approval vs before PERM approval? schintala Posted January 26, 2012 Report Share Posted January 26, 2012 As far as I know, you can retain the PD even after employer revoked I140 as long as it not fradulent. But check with immgration experts. Link to comment
