johnveslin Posted January 23, 2012 Report Share Posted January 23, 2012 With my previous employer, GC was started under EB3 category and labor certification was approved during 2008. however I have changed the employer prior to apply I-140. Now with my current employer, we have started GC during 2011 under EB2 category and I-140 is approved. Both current & previous employers filed GC for same job designation. PD is the date first an Application filed with Labor, so can I use 2008 as my PD? should I need to check with my lawyer? Link to comment
JoeF Posted January 23, 2012 Report Share Posted January 23, 2012 You can not reuse the old PD, since that's only possible if the old employer had filed an I-140 and gotten it approved. The case with the new employer is a new case with a new PD. Link to comment
