H4 Approved without I-94 Card

Hi,

I applied H4 extension along with my husbands H1B extension on Aug 2nd 2011. We both traveled to India on Oct 1st and back on Nov 1st 2011. My husbands H1B is approved on Dec 15th 2011 and got I-94 card along with the approval.

My H4 is approved on Jan 5th 2012 but I-94 receipt is NOT attached to I539 approval notice. I-94 in my passport is valid until Dec 1st 2011.

Do i need to apply for amendment to get I-94 on the approval notice? Am i out of status from Dec 2nd 2011?
