kr2011
Hello, I would like to know if one goes from H1B to F1 and tries to apply for a H1 again, though the old h1 expired 5 years ago, will it still be considered as part of the cap? Link to comment
Attorney_24
Generally, an individual who has previously held H-1B status in the last six years has already been counted against the cap and is not subject to the cap. Kindly consult with an immigration attorney to discuss specific facts concerning your case in order to determine if you are cap subject or cap exempt. Link to comment
