Now i have joined employer B and dont have much time left on my H1B. If my labor (filed by employer A) is approved and can i use that one with employer B for 7th year extension (with employer A approval) Can you please let me know? Thanks, RC10 Link to comment

aboppana Posted January 1, 2012 Report Share Posted January 1, 2012 no, you cannot use PERM approved from Employer A, to extend your H1B with company B. your new company would have to apply for PERM again, and the ony way to file 7th year extension with Company B is to have the PERM approved fron Company B before end of your 6th year. " Yes even if A is not willing. In this scenario you would need to get the H1 extension based on the job with B before the I-140 is revoked..if at all. Obviously you may need to restart the GC process with any other employer including B though you get tom retain the PD. Link to comment
